Apple has lost its bid to add the new Galaxy S4 to its ongoing patent lawsuit against Samsung. U.S. Magistrate Judge Paul S. Grewal said that adding yet another device to the case is a “tax on the court’s resources,” and that it takes time away from other parties who require the court’s attention.

The lawsuit already includes a long list of Samsung devices, including the previous-generation Galaxy S III, and a number of Galaxy Tab slates. Apple agreed to remove another Samsung device so that it could add the Korean company’s latest flagship to the complaint, but Judge Grewal has refused the request.

“Each time these parties appear in the courtroom, they consume considerable amounts of the court’s time and energy, which takes time way from other parties who also require and are entitled to the court’s attention,” Judge Grewal said on Wednesday, according to a Reuters report.

Josh Krevitt, a lawyer representing Apple, argued that excluding the Galaxy S4 from the case “would require Apple to file a new lawsuit.” But clearly Judge Grewal wasn’t buying it.
